1. Purpose and Scope
This Anti-Fraud Policy (“Policy”) outlines the commitment of Sophy Music LLC (“Sophy Music,” “we,” “us,” or “our”) to maintain the integrity of our platform, services, and partner relationships. Fraudulent or abusive activity undermines the credibility of our system and the fairness owed to all users and partners. This Policy applies to all artists, labels, managers, distributors, and any other user or entity engaging with Sophy Music’s services (“Users”).
2. Definition of Fraudulent Activity
Fraud includes, but is not limited to, any intentional action or omission that manipulates, falsifies, or misrepresents data, usage, or rights to obtain unauthorized benefits. Examples include:
- Artificially inflating streams, downloads, views, or interactions through bots, click farms, or other non-human means.
- Submitting recordings or content that infringe upon third-party copyrights or trademarks.
- Misrepresenting ownership, rights, or licensing of content.
- Manipulating metadata, ISRCs, or identifiers to redirect royalties or misattribute revenue.
- Engaging in deceptive or misleading marketing practices.
- Falsifying reports, invoices, or financial information.
- Attempting to circumvent payment systems or create multiple fraudulent accounts.
3. Fraud Detection and Monitoring
Sophy Music employs advanced analytical tools, internal audits, and third-party fraud detection systems to identify unusual activity across DSPs and user accounts. We may collaborate with digital platforms such as Spotify, Apple Music, YouTube, and others to detect and verify fraudulent activity. All accounts are subject to ongoing monitoring, and suspicious activity may result in:
- Immediate withholding of royalties
- Suspension or termination of the user's account
- Permanent removal of affected content from DSPs
- Reporting to DSPs, rights holders, or legal authorities
4. Investigation Process
When fraudulent or suspicious activity is detected:
- The user may be notified and asked to provide documentation verifying their rights or activity.
- Sophy Music reserves the right to temporarily freeze payments or access during investigation.
- If the claim is verified, Sophy Music will take corrective action, including royalty forfeiture and account termination.
- If fraud is confirmed, affected DSPs and partners may also apply sanctions or remove the content globally.
5. Consequences of Fraud
Confirmed fraudulent activity may result in:
- Immediate account termination without prior notice
- Forfeiture of all unpaid royalties associated with the fraudulent activity
- Permanent ban from using Sophy Music's services
- Legal action seeking damages and compensation for losses incurred
- Notification to DSPs and law enforcement authorities
All rights to determine the existence and extent of fraud lie solely with Sophy Music LLC, based on evidence gathered from internal and external investigations.
6. Appeals
Users who believe that an action taken under this Policy was made in error may submit a written appeal to fraud@sophymusic.com within ten (10) business days of receiving notice. Appeals must include sufficient evidence demonstrating ownership, legitimacy, and compliance with applicable laws and platform rules. Sophy Music will review all appeals fairly but is not obligated to reinstate accounts or payments.
7. Cooperation with Partners and Authorities
Sophy Music cooperates fully with digital service providers (DSPs), collection societies, and law enforcement authorities in all fraud-related matters. We may share data, reports, and user information necessary for investigation or enforcement under applicable laws.
8. Policy Enforcement
Violation of this Policy will be handled in accordance with our Terms of Use, Distribution Agreements, and applicable laws. Sophy Music reserves the right to modify or update this Policy at any time to ensure compliance with evolving industry standards and legal requirements.
